Terms of Service

1. What these terms cover

These terms govern your use of Eigon ("the Service"), operated by Eigon ("we", "us"). By creating an account you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

2. What Eigon does

Eigon deploys your source code onto cloud infrastructure that we operate on your behalf. We provision, configure and run that infrastructure; you supply the code and the configuration that runs on it. We do not review your code before deploying it.

3. Your account

You are responsible for the security of your credentials and for everything done through your account. Tell us promptly at info@eigon.io if you believe an account has been compromised. You must be at least 18, or the age of majority where you live.

4. Acceptable use

Because your workloads run on infrastructure we own and pay for, some uses are prohibited outright. You may not use the Service to:

  • mine cryptocurrency, or run distributed computation whose main purpose is to consume compute rather than serve an application;
  • send unsolicited bulk email, or operate phishing, malware or command-and-control infrastructure;
  • attack, scan or overload third parties, or attempt to reach other customers' environments or our control plane;
  • store or process content that is unlawful where you or your users are located, or that infringes someone else's rights;
  • resell raw compute or storage as a competing infrastructure product;
  • deliberately evade plan limits, spending caps, or billing.

We may suspend or terminate an account that breaches this section. Where the breach is causing active harm or unbounded cost, we may act immediately and tell you afterwards; otherwise we will contact you first.

5. Your content and your code

You keep all rights to your code, data and content. You grant us only the licence needed to run the Service: to store, copy, build and execute your code on infrastructure we operate, and to display your content back to you in the dashboard. We claim no ownership and we do not use your code to train models.

6. Plans, billing and spending

Paid plans are billed in advance for the period shown at checkout. Fees are exclusive of taxes unless stated. Plan fees are non-refundable except where required by law or where we have clearly failed to provide the Service.

Every environment carries a monthly spending cap. When an environment reaches its cap we stop new deployments and scale its compute down, so that infrastructure cost cannot run away unattended. You can raise a cap at any time, and raising it is what authorises the additional spend. Estimates shown in the dashboard are estimates: actual cloud usage governs.

We may change prices with at least 30 days' notice, effective at your next renewal. If you do not accept a change you may cancel before it takes effect.

7. Availability

We work to keep the Service available but do not promise uninterrupted operation unless a separate written agreement says otherwise. We may perform maintenance, and will give notice for planned work that we expect to be disruptive.

8. Cancellation and termination

You may cancel at any time from the dashboard; your plan runs to the end of the paid period. We may terminate for breach of these terms, for non-payment after notice, or if we discontinue the Service. On termination we will give you a reasonable opportunity to export your data before deleting it, except where a breach of section 4 makes that inappropriate.

9. Warranties and liability

The Service is provided "as is". To the extent permitted by law we exclude implied warranties. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, our total liability arising out of the Service in any 12-month period is limited to the fees you paid us in that period, and we are not liable for indirect or consequential loss, loss of profit, or loss of data to the extent it results from your failure to keep your own backups.

10. Changes to these terms

We may update these terms. For material changes we will give notice by email or in the dashboard before they take effect. Continuing to use the Service after that constitutes acceptance.
